Abortion has been legal in Alaska since the legislature enacted Alaska Statutes Title 18 Chapter 16, Regulation of Abortions, in 1970 (before Roe). Alaska favors a strong right to privacy, which has allowed for enhanced protections of abortion rights. In 1997, the Supreme Court of Alaska ruled that abortion rights and are fundamental and are encompassed within the right to privacy expressed in article I, section 22 of the State Constitution. This decision also held that restrictions on abortion in Alaska are subject to strict scrutiny.
